Seven Things To Check In A UGC Licence

This is where the market is genuinely messy, and where ads get pulled.

There are two permissions, not one

The right to use the footage, and the right to use the creator's own handle or account. Different grants, and they are frequently confused for each other.

They can expire on different clocks

On one marketplace's published terms, the asset licence is perpetual while permission to use the creator's handle ends after 30 days. Read both dates, not one.

Whitelisting is a third thing again

Running ads from the creator's own account needs account-level access, granted and revoked separately from any content licence. Ask explicitly whether it is included.

Organic use is not paid use

Some agreements permit posting but not advertising. Look for the word "paid" in the grant, and for any spend cap attached to it.

Exclusivity and category lockouts

Whether the creator can film for a competitor next month, and for how long they cannot. If the agreement is silent on this, do not assume you have any, and ask for it in writing either way.

Territory and channel limits

A licence for Meta is not automatically a licence for TikTok, YouTube, your site or a paid partnership label. Check the channel list, not just the duration.

Whether it is written up front

What is a UGC ad agency?

Providers differ mainly in how many of those four they actually cover, and the gaps are where the work quietly returns to your team.

What is the difference between UGC and influencer marketing?

What you walk away owning. Influencer marketing buys access to someone's audience, and the post lives on their channel, so reach and association are the deliverable and follower count drives who you pick. UGC for ads buys footage that runs from your own ad account, so usable creative at volume is the deliverable and how someone reads on camera drives who you pick. The same person can do both, which is why the terms get used interchangeably, but the purchase is not the same.

Do I own the UGC footage?

You get perpetual commercial rights to the footage we produce, in writing, agreed before anyone films. The reason to ask this of every provider is that ownership and licensing are not the same word and in this market they are often used as if they were. The document should cover the footage, the creator's own handle, paid amplification, territory, channels and duration together, with whitelisting stated as its own grant rather than assumed. Any provider who cannot produce that document before the shoot is a risk regardless of price.

How long can I run creator footage in paid ads?

With us, indefinitely: the rights to footage we produce are perpetual. Across the market it depends entirely on the licence, and the trap is that two permissions can expire on different clocks. On one UGC marketplace's published terms the licence to the asset is perpetual while permission to use the creator's own handle ends after 30 days, which means the footage stays legal while running it from their account does not. Get both dates in writing whoever you use.

What is whitelisting, and do I need it?

Whitelisting means running ads from the creator's own account rather than your brand page, so the ad carries their handle. It is a separate permission from any content licence, it requires account-level access to be granted and later revoked, and it is frequently assumed rather than agreed. Whether you need it depends on whether the creator's name is doing work in the ad. Plenty of strong creator ads run from the brand account and never need it.

How do you find and vet creators?

By category fit and how they read on camera rather than by follower count, because we are buying footage rather than reach.
